交警查明，今年1月21日8时57分，男子王某（今年21岁，荆门人，持C1驾照）驾驶一辆越野车从碧桂园出发沿滨湖路由南向北行驶，当车行驶至碧桂园三期西侧路段处超速行驶，在超越同向前车时车辆越过道路中心双黄实线驶入对向车道，与对向驶来的一辆轿车相撞，造成轿车司机严先生（殁年43岁）抢救无效身亡（后经鉴定，系生前因交通事故致急性重型颅脑损伤导致脑机能障碍死亡）及两车、行道树受损的交通事故。

事后，从王某及严先生的血液中均未检出“乙醇”成分，也就是说，事发时两人均未饮酒。

经交警现场勘察和调查取证证实，王某驾驶机动车在道路上超速行驶，在超越同向前方车辆时车辆越过道路中心双黄实线驶入对向车道，与对向来车相撞，是造成此事故发生的直接原因，其行为违反了《中华人民共和国道路交通安全法》第38条“车辆、行人应当按照交通信号通行；……”和第42条第1款：“机动车上路行驶，不得超过限速标志标明的最高时速，在没有限速标志的路段，应当保持安全车速”之规定。

根据《中华人民共和国道路交通安全法实施条例》第91条和《道路交通事故处理程序规定》第46条第1款第（1）项之规定，市公安局交警支队事故处理大队认定：王某承担此起事故的全部责任，严先生不承担此起事故的责任。

检方指控

应以交通肇事罪追究刑责

东宝区人民检察院指控，今年1月21日9时左右，被告人王某驾驶辽BXXXX7雷克萨斯牌越野车沿滨湖路由南向北行驶，当行驶至碧桂园三期西侧路段处时超速（限速50km/h，行驶速度约108.4km/h）行驶，其在超越同向前车时越过道路中心双黄实线驶入对向车道逆行，与对向驶来的严先生驾驶的鄂HXXXX5起亚牌轿车相撞，造成严先生受伤后经医院抢救无效身亡及两车、行道树受损的交通事故。

公诉机关认为，被告人王某的行为已触犯《中华人民共和国刑法》第133条之规定，应当以交通肇事罪追究其刑责，并提供了相应的证据。

一审判决

王某犯交通肇事罪领刑一年半

东宝区人民法院审理查明相关事实。

另查明，本案被害人亲属就民事赔偿在东宝区人民法院已另行提起民事诉讼，经该院调解，双方未能就本案民事赔偿部分达成协议。案发后被告人王某于今年1月21日在公安机关交纳了事故押金4万元，同年1月25日在公安机关交纳事故押金10万元，同年5月8日在该院交纳64万元。

该院认为，被告人王某违反道路交通运输管理法规，因而引发致一人身亡的交通事故，且负事故的全部责任，其行为已构成交通肇事罪，公诉机关指控的罪名成立。被告人王某案发后拨打电话报警并在现场等候处理，归案后如实供述自己的罪行，系自首，可从轻处罚，对辩护人提出被告人王某有自首情节，应对他从轻处罚的辩护意见予以采纳。

综上，依照《中华人民共和国刑法》第133条、第67条、《最高人民法院关于审理交通肇事刑事案件具体应用法律若干问题的解释》第2条之规定，判决被告人王某犯交通肇事罪，判处有期徒刑1年6个月。

交通肇事罪量刑有规定

湖北新天律师事务所律师刘军分析认为，根据《最高人民法院关于审理交通肇事刑事案件具体应用法律若干问题的解释》第2条第1款：交通事故致身亡1人或者重伤3人以上，负事故全部或者主要责任的，构成交通肇事罪，处3年以下有期徒刑或者拘役。

肇事者归案后若主动投案、如实供述自己的罪行，被认定为自首后，会受到从轻处罚。

刘军提醒广大司机朋友，开车切记安全、文明驾驶，特别在行人及车流量大的地方，更应该减速慢行，多观察来往行人和车辆，预防交通事故的发生。
